Licensing (Scotland) Act 2007 - Update

The transitional period under the Licensing (Scotland) Act 2005 commenced on 1 February 2008, and licence holders have until 1 September 2009 to apply for the new premises and personal licences under the Act. Licence holders are expected to lodge their premises applications in phases in order to avail themselves of the limited “grandfather” rights under the Act depending on the month in which their existing licence falls due for renewal.

Expiry in March Lodging Date 7 March 2008
Expiry in June Lodging Date 6 June 2008
Expiry in October Lodging Date 3 October 2008
Expiry in January Lodging Date 16 January 2009

Premises licence application forms required to be lodged with an operating plan, layout plan and the prescribed fee which is now based on Ratable Value. The fees are considerably higher than the existing fees and are based on the cost recovery principle.
