Powers of Attorney & Guardianship

Powers of Attorney

Putting in place a Power of Attorney offers the peace of mind knowing that your affairs will be dealt with, by persons of your choosing, in the event that you are no longer able to manage them yourself. It will also greatly help your loved ones should such a situation arise.

There are different types of Power of Attorney and they can be as limited or wide-ranging as you require, allowing them to be specifically tailored to suit your individual needs. Powers of Attorney are dealt with by Mairi Hendrie and Morven Culbertson in our Wills & Executries Team in Fort William and Billie Smith in Oban.

Guardianship

Unfortunately, there may come a time when someone close to you no longer has capacity to make decisions regarding their welfare and finances. If they don’t already have a Power of Attorney in place, then this can leave them in a very vulnerable position. Practically, this also causes many problems as medical professionals, care homes and financial institutions are not able to deal with or take instructions from you without legal authority to do so. The Adults with Incapacity (Scotland) Act provides the framework for applying to the Court for various measures such as being appointed Guardian to deal with welfare and/or financial matters on the adult’s behalf.

Our team have vast experience in dealing with such situations and can guide you through all aspects of the process to ensure that your loved one’s needs are met as swiftly as possible. Guardianship applications to the Court and matters regarding Adults with Incapacity are dealt with by our Family Law Team of Claire MacAlpin (Partner) in Fort William and Billie Smith (Partner) in Oban.
